MicroStrategy Incorporated, a provider of business intelligence software, announced that it has won summary judgment dismissing a lawsuit brought by Business Objects, S.A. alleging that MicroStrategy infringed United States Patent No. 5,555,403, entitled "Relational Database Access System Using Semantically Dynamic Objects" ("the '403 patent"), owned by Business Objects. MicroStrategy says, “In a memorandum opinion and order entered August 29, 2003, the United States District Court for the Northern District of California ruled that Business Objects' claims were factually and legally unsupported and held as a matter of law that MicroStrategy's products do not infringe the '403 patent. The court dismissed Business Objects' lawsuit, which sought injunctive relief and damages in excess of $100 million, with prejudice.”
"This is a great victory for MicroStrategy and its customers, employees, and shareholders," said Jonathan F. Klein, MicroStrategy's Vice President, Law & General Counsel. "We have invested many millions of dollars to develop and deliver the industry's most advanced and scalable business intelligence solutions. The court's ruling confirms the substantial differences between MicroStrategy's enterprise-class technology and the basic ideas embodied in Business Objects' products and '403 patent filed more than a decade ago," continued Klein.
MicroStrategy's separate, affirmative lawsuit against Business Objects for patent infringement, misappropriation of trade secrets, and tortious interference with contractual relations is expected to proceed to trial in federal court in Norfolk, Virginia, in late 2003 or early 2004.
